Second Report to Parliament
on the
Review of Legislation Governing the Disclosure of Information

November 2002



Part I: Explanatory

  1. This report is a compilation of contributions from all the major legislation-making departments. Departments were asked to list items of both primary and secondary legislation which prohibit disclosure together with items of legislation which provide discretion to disclose.

  2. Departments were asked to review this legislation in light of the provisions of the Freedom of Information Act 2000 in particular the protection afforded to certain information by the exemptions in Part II of that Act.

  3. This report updates an earlier report published in May 2002. A small number of items have been added to the list. A larger number have been identified as not containing a prohibition on disclosure at all but rather some other provisions relating to disclosure of information and these are identified as items included in error. A number of items have been reallocated to different departments in order to reflect recent machinery of government changes. Finally a number of items previously identified have been repealed by other legislation.

  4. This report does not identify legislation made by the National Assembly for Wales, the Northern Ireland Assembly or the Scottish Parliament. It identifies some legislation relating to Northern Ireland. It also includes some items which relate to devolved matters. Where items relating to devolved matters have been identified for repeal or amendment, this will be effective only as regards England, Wales and Northern Ireland. It will be for the Scottish Parliament to determine what should be done as regards Scotland.

  5. The Government is committed to reducing the number of provisions prohibiting the disclosure of information. However, it has identified primary criteria for retaining certain provisions where:

  1. Of those items in the report identified for repeal or amendment, the majority will be repealed or amended using the powers contained in section 75 of the Freedom of Information Act 2000. However, a number of Department of Trade and Industry items will be repealed by provisions contained within Part 9 of the Enterprise Act 2002. Part 9 is devoted to disclosure provisions for specified information obtained under consumer and competition legislation. The purpose of these provisions is to create a new, unified regime for the sharing of this consumer and competition information by public enforcement authorities, and to allow disclosure to any person in connection with the investigation of any criminal offence in the United Kingdom or for the purpose of bringing criminal proceedings in this country. The provisions build upon the model established under the Anti-Terrorism, Crime and Security Act 2001. Part 9 will simultaneously repeal the existing disclosure provisions contained in the specified pieces of individual legislation and enable information acquired under this legislation to be disclosed under carefully designed gateways.

  2. The review includes a number of items which provide discretion to disclose. The Freedom of Information Act 2000 will overlay these existing discretionary powers with an access right and the Government will seek to amend or repeal as many of these items as possible.

  3. The Government is aware that the effect of many of the items identified is to prohibit disclosure of information in perpetuity. The Government does not consider this to be desirable and will seek to introduce time limits into those items that are identified for retention.

  4. The review has identified mostly legislation presently in use. The next stage of the review will include checking databases and other sources to flush out any obscure and dated items.

  5. Pre-commencement enactments (i.e. Acts passed before devolution) relating to reserved matters and extending solely to Scotland and Wales, have (with some small exceptions) not formed part of this stage of the review but will be included in the next stage.

Because the inspectors have a right to compel others to allow them to enter their premises, this item will be retained.

Section 449 of the 1985 Act places a bar on disclosure of information relating to a company obtained by the exercise of the Secretary of State's compulsory power in section 447 of that Act to require from a company or other person production and explanation of documents. There are gateways for public authorities engaged in law enforcement and regulatory purposes. This power is exercised by the Inspector of Companies to investigate information received about the conduct of company affairs.

Section 86 of the 1989 Act places a bar on disclosure of information relating to the business or other affairs of a person supplied by an overseas regulatory authority in connection with a request for assistance or obtained in the exercise of the Secretary of State's discretionary powers in section 83 of that Act. Those powers may be used to place a requirement upon a company or other person to produce documents and/or to furnish information for the purpose of assisting an overseas regulatory authority with functions that relate to companies or financial services. Under section 87 there are gateways allowing transfer of information to public authorities engaged in law enforcement and regulatory purposes.

These items protect information obtained from companies, regulatory authorities and other parties in connection with company investigations.

Information protected by these items is gathered under compulsion in connection with these investigations. These items will therefore be retained.

The international standard in patent law is that a patent application be secret for 18 months and then published. These items set out what the Patents Comptroller must disclose to the public and what must be refused. The Comptroller has no way of determining what would constitute commercially confidential material and what would not. These items provide a system whereby everything prior to publication is not for disclosure but almost everything is published 18 months after receipt. A change to this would be overwhelmingly burdensome for both the Patents Office and for business. Certain information will not be published after the specified time. This is information whose disclosure would be prejudicial to the defence of the realm or public safety. However, each piece of information that is withheld must be periodically reviewed to determine whether the withholding is still judged necessary. These items therefore also provide for a harm test analogous to those in the Freedom of Information Act 2000. These items provide for a limited and specific access regime and will therefore be retained.

These items place a duty on the Heads of the Intelligence and Security Agencies to ensure that no information is disclosed (or obtained) except so far as necessary to the proper discharge of the Agencies' statutory functions. The Foreign and Commonwealth Office, in consultation with the Home Office, considers that these provisions form an essential and integral part of the statutory governance of the Agencies and it is right that the provisions are retained within the primary legislation for that purpose. The Agencies are not covered by the Freedom of Information Act 2000 and therefore these items will be retained.

Rehabilitation of Offenders Act 1974, section 9
This item provides protection for the rehabilitated individual from the obligation to disclose information out of court on spent convictions. Specifically, it prohibits disclosure by persons having access at any time to official records relating to spent convictions and provides for imposition of a fine on summary conviction. It is a restriction on disclosure by individuals who may not be covered by the Freedom of Information Act 2000 and will therefore be retained.

This item requires that the Commissioners of the Inland Revenue carry out valuations of dwellings and furnish listed officers with information obtained in carrying out the valuations and information requested from owners and occupiers. It allows the Commissioners to appoint people who are not in the employ of the Crown to assist with valuations and to supply the information to them. It makes it an offence to disclose or use information other than for the purpose of valuation. The information is gathered under compulsion and therefore this item will be retained.
