The Lord Chief Justice handed down a Practice Direction on court dress on 21 December 2007. With effect from 2 January 2008, the Practice Direction applied throughout the Supreme Court in England and Wales, including the Crown Court, in county courts and in magistrates' courts.

The President of the Queen's Bench Division handed down an amendment, number 19, to the Consolidated Criminal Practice Direction on 30 March 2008. This introduced two forms for use in connection with the new rule 50.3 within new Part 50 of the Criminal Procedure Rules 2005. Part 50 sets out the rules for civil behaviour orders after verdict or finding in a criminal case and these came into force on 7 April 2008.

The text of the amending Practice Direction (PDF) is available and the amendment can also be viewed online in the Consolidated Practice Direction.

The forms are (i) Notice of intention to apply for an anti-social behaviour order if the defendant is convicted and proposed application;

and

(ii) Notice of intention to apply for a serious crime prevention order if the defendant is convicted of a serious offence and proposed application.

These replace the five forms set out in Annex D for use in connection with Part 50.

6th Update, March 2008 – This update contains:

  1. the changes to the Criminal Procedure Rules 2005 made by The Criminal Procedure (Amendment No. 3) Rules 2007, affecting the rules about case management (Part 3), the procedure for applying in criminal cases for an anti-social behaviour order or other civil behaviour order (Part 50), the procedure for applying to the Court of Appeal for permission to appeal, or to refer a case to, the House of Lords (Part 74); new rules in Part 2 that explain when the new rules in Parts 50 and 74 apply and that make transitional provisions about other amendments made by these rules; amendments in Part 65 to take account of Part 74 changes; amendments of Part 68, appeals about conviction or sentence, to take account of provisions in the Serious Crime Act 2007 that confer rights of appeal in respect of a serious crime prevention order; the amendment of the rules about appeals to the Court of Appeal under the Proceeds of Crime Act 2002 (Part 71) to take account of changes to Part 65; and amendments of Parts 57 to 62, to take account of provisions in the Serious Crime Act 2007 that abolish the Assets Recovery Agency and amend related provisions in the Proceeds of Crime Act 2002, to which those rules apply.
  2. the change to the Consolidated Criminal Practice Direction at paragraph IV.34, 'Settling the Indictment', made by Amendment No. 17 which was handed down on 30th November 2007 and in force from 3rd December 2007.

The rule changes affecting Parts 57 to 62 of The Criminal Procedure Rules 2005 come into force on Tuesday, 1st April 2008 and the remainder come into force on Monday, 7th April 2008. A full description is in the Notes to Accompany this update.
