The consultation paper sought views on the establishment of a national model for the provision of Justices' Clerks within Her Majesty's Courts Service. It proposed setting a consistent approach to the role of Justices' Clerks within England and Wales. It also considered the positioning of such posts within the structure of Her Majesty's Courts Service in the light of the 42 different models inherited from former Magistrates' Courts Committees and the absence of a national rationale for their provision.
This summary of response has confirmed the appropriateness of reviewing the provision of Justices’ Clerks posts from a national perspective, identifying numerous factors that could be taken into account. The HMCS Board will be asked to provide a steer as to how this issue is to be taken forward.
