The consultation paper invited views on whether non legally qualified staff should be able to carry out certain delegated functions under the Justices' Clerks Rules 2005, provided they have the relevant experience as deemed fit by the justices' clerk. The paper also posed the following questions:-
This report informs respondents of how the consultation process has influenced decisions on the way forward and the conclusions that we have reached on the proposals. A total of 85 responses were received. In response to the key question of whether some justices' clerks functions should be delegated to non legally qualified staff, 72 respondents agreed that staff should be able to undertake these functions. Of those 50 were in favour of an amendment by Secondary Legislation, 18 preferred Primary Legislation, with 4 wishing to retain the status quo.
