Compensation Act 2006: exemptions from the requirement for authorisation

Section 6 of the Compensation Act 2006 gives the Secretary of State the power to exempt by order persons or classes of person from the requirement for authorisation. This paper seeks views on the use of that power.

Consultation paper

This consultation document sought views on the classes of persons that might be exempted from authorisation under the Compensation Act. The proposals included those covered by other regulation (i.e.solicitors), trade unions and charities and not for profit bodies.


Responses

This report summarises responses to the consultation relating to Claims Management Regulation, including the exemption of particular classes of person. A number of changes have been made to the exemption order since the consultation ended including clarifying the position of those regulated under the FSMA 2000, defining the level of business involvement allowed for small introducers and defining more clearly a union member.
