A consultation by the Department for Constitutional Affairs

Civil Court Fees

June 2005

[CP(R) 10/05]

This consultation was published on 5 May 2004, it invited comments on four specific questions on the proposed civil and family fee changes and on the current exemption and remission provisions.

The consultation period closed on 28 July 2004. The summarised responses report outlines the conclusions reached on the options.

Consultation Paper

This consultation paper invited comments on:

  1. Whether the proposed changes to the civil court fees fairly balanced the need to set fees in line with cost and the need to avoid excessively large fees.
  2. Whether a particular charge or increase in an individual fee might have specific, untoward consequences for a particular group of users.
  3. The proposal that a single cost recovery target be set covering county courts and the Supreme Court.
  4. Whether the current exemption and remission provisions would not provide an adequate guarantee of access to justice.
