Exercise of Concurrent Powers under the Welsh Language Act 1993
The Welsh Assembly Government will seek to exercise the powers under
sections 25 and 26 regarding the prescription of Welsh forms, only in
connection with those functions which have been transferred to the National
Assembly for Wales. The Lord Chancellor will exercise the powers under
sections 25 and 26 only in connection with functions retained by him.
(For
example, where the Lord Chancellor has the power to prescribe forms
for use in magistrates' courts he may exercise the power under
section 26 to prescribe forms in Welsh as well as in English. Where
the Assembly has the power to prescribe forms under the Housing Act
1988 it could, under section 26, prescribe such forms in Welsh as
well as English.)
The Lord Chancellor retains the power to prescribe
the form of words of the judicial oath. He may exercise his power
under section 26 to
prescribe the form of words of the oath in Welsh as well as in English.
