Advisory Committee on Private International Law
Terms of Reference
There shall be a Committee whose purpose is to provide advice to Ministers
and officials in connection with issues relating to Private International
Law. This shall include the provision of advice in connection with the following
particular matters:
- The continuing negotiations at the Hague Conference on Private International
Law on an agreement covering jurisdiction and the recognition and enforcement
of judgments in civil and commercial matters in the context of commercial
choice of court agreements.
- The continuing negotiations within the European Union on an instrument
containing choice of law rules in relation to non-contractual matters
("Rome II").
- Future negotiations within the European Union on an instrument to replace
the 1980 Rome Convention on the Law Applicable to Contractual Obligations
("Rome I").
- References from national courts to the European Court of Justice which
raise significant private international law issues, particularly in connection
with the interpretation of EC Regulation 44/2001 ("the Brussels I
Regulation") and the Rome I Convention.
- Other significant issues of private international law whether arising
under the law of any of the United Kingdom jurisdictions or in connection
with other international negotiations (whether those are taking place
within the European Union or more widely).
The members of the Committee shall be appointed by Ministers in the Department
of Constitutional Affairs and the Scottish Executive Justice Department;
they shall consist of judges, practitioners and academics with the necessary
expertise in this area of the law. The members shall also include officials
from those departments and, as appropriate, representatives from other departments
with substantial interests in this area.
